All services provided by Deste FZ-LLC Reg. No. 0000004022588, Licence No. 45000068, Address: A4-402, Building no. A4, Al Hamra Industrial Zone-FZ, RAK, United Arab Emirates (hereinafter referred to as Service ) are governed under the 'Terms and Conditions of Service' set forth below. We reserve the right to revise these 'Terms and Conditions of Service' at any time, and such revisions will be binding. You should therefore regularly visit this page to review these 'Terms and Conditions of Service'.
Please read this agreement carefully before registering on the Service. By registering for the Service, paying for our services, or using any part of the website or corresponding services, you signify your acceptance of the "Terms of Service". If you do not agree with one or more of the conditions presented, you may not access the website, nor use any of its services.
1. The Service undertakes, on a paid basis, on behalf of the Client, to perform the following actions on its behalf:
purchase of goods in online store and Internet auctions in the United States or Germany (hereinafter referred to as the “Seller”) under the terms of this Agreement;
receiving, storage and processing of Goods purchased on behalf of or by the Client himself;
delivery of goods purchased on behalf of or by the Client himself, by transferring them to the postal service and / or carrier;
receiving, sorting, sending and handing over to the postal company of parcels and/or correspondence of the Client with further sending to the specified address and the chosen delivery method.
2. Under the terms of this Agreement, the delivery of goods, parcels and/or correspondence is carried out to Oman, the United Arab Emirates, Saudi Arabia, Qatar, Bahrain, Kuwait.
3. The Service withholds a fee from the Client according to the rates posted on the site dester.io (hereinafter referred to as the Site). The Client expresses his agreement and provides the Service the right to receive, store, process and transfer his personal data.
4. Only persons over 18 years of age can use the Service. Persons under the age of 18 may use the Service only under the supervision of a parent or guardian. The Service Client is an adult individual who has accepted the terms of this offer, who buys and sends goods for private use. The Client agrees that the Service has the right to engage third parties to fulfill its obligations under this Terms of Service. 5. By applying for membership, you authorize The Service to, directly or through third parties, make any inquiries we consider necessary to validate your identity. For example, you may need to verify ownership of your email address or credit card used to pay.
6. The Service provides each Client with a postal address, which includes a unique suite number, for use in the United States of America and Germany.
7. The Client's address is for mail and package shipping purposes only. The Client is not permitted to use his address for other purposes, i.e., for example, registering in stores, billing or invoicing, setting up bank accounts or credit card accounts, establishing websites or registering domain(s) , etc.
8. The Service is not a shipping carrier. The Service takes responsibility for the contents of the package from the moment it is sent from our warehouse until the moment it is received by the Client when ordering the additional Package protection program. Rates and description of this service are indicated on the website.
9. The Service delivers only by the shipping methods offered on our website.
10. It is the Client's responsibility to make sure that a package can be shipped. Clients must ensure that a package’s contents, size, weight, volume, destination and/or recipient are not subject to prohibitions or restrictions in the country of origin or destination country.
11. The Client is responsible for, and warrants the compliance of, packages and mail with all applicable laws, rules, and regulations, including, but not limited to, the export laws and government regulations of any country to, from, through, or over which the shipment may be carried. The Service does not guarantee the delivery of packages which do not comply with the import regulations of the destination country or export regulations. The client also undertakes to familiarize himself with the additional restrictions of the courier company on the website in advance.
12. The Service is not responsible for packages addressed to prohibited countries, individuals, or entities. If we cannot ship your package due to these prohibitions and restrictions, you agree to either return it to the original sender, or to send it to a different address. 13. The Service is not responsible for packages which exceed the size, weight, or volume allowed by individual destination countries. It is the Client’s responsibility to ensure that the package in which they are shipping is within the size, weight, and volume restrictions that apply in the country of origin or destination.
14. All incoming mail is accepted in our warehouse, identified, and added to the Client's account.
15. The Client must ensure that the correct name, package number, and mailing address is on every package sent to our warehouse.
16. The Service determines the owner of the parcel, after it arrives at the warehouse, and adds it to the Client's account. If the owner cannot be determined, and a claim with tracking information is not provided within 14 days, the package will be disposed of.
17. Receiving and processing packages and mail is free for all Clients. Processing consists in the consolidation, packaging and transfer to a logistics company for delivery to the selected address. 18. The Service automatically provides two general view photos for each incoming package upon receipt.
19. The Service removes the original packaging for free and repackages parcels before dispatching them. The Service reserves the right to make the final decision on the type of packaging of delivery methods.
20. The Service also removes seller invoices and promotional products from the final package for free.
21. The period of storage in the warehouse of incoming parcels and outgoing parcels is counted separately.
22. Free storage period of the incoming package is 30 days from the date of registration in the Client's account. Further, the period of storage of the parcel can be extended on a paid basis up to 90 days. After 90 days of storage an incoming package will be recycled. If an outgoing parcel is formed and packed in the warehouse, but payment for delivery is not made within 14 days, then this package will be recycled too.
23. The Service only accepts credit or debit card payments from the countries listed here: Algeria, Anguilla, Andorra, Antigua and Barbuda, Argentina, Armenia, Australia, Austria, Azerbaijan, Bahamas, Bangladesh, Bahrain, Barbados, Belarus, Belgium, Belize, Benin, Bermuda, Brazil, Bhutan, Brunei, Bulgaria, Burkina- Faso, Burundi, Canada, Cayman Islands, Chile, Comoros, Cook Islands, Costa Rica, Croatia, Cyprus, Czech Republic, Denmark, Dominica, Dominican Republic, East Timor, Egypt, Equatorial Guinea, Eritrea, Estonia, Faroe Islands, Fiji, Finland, France (and overseas territories), Gabon, Georgia, Germany, Gibraltar, Greece, Greenland, Grenada, Guatemala, Guernsey, Guinea, Guinea-Bissau, Guyana, Haiti, Honduras, Hong Kong, Hungary, Iceland, India, Ireland, Isle of Man, Israel, Italy, Japan, Jersey, Jordan, Kazakhstan, Kiribati, Kyrgyzstan, Laos, Latvia, Lesotho, Libya, Liechtenstein, Lithuania, Luxembourg, Republic of Macedonia, Madagascar, Malawi, Malaysia, Maldives, Mali, Malta, Marshall Islands, Mauritania, Mauritius Mexico, Federated States of Micronesia, Moldova, Monaco, Mongolia, Montenegro, Nauru, Netherlands (and overseas territories), former Netherlands Antilles, New Zealand, Niue, Norway, Palau, Panama, Papua New Guinea, Peru, Philippines, Poland, Portugal, Qatar, Russia, Samoa, San Marino, Sao Tome and Principe, Saudi Arabia, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Serbia, Seychelles, Singapore, Slovakia, Slovenia, Solomon Islands, Swaziland, Tajikistan, Togo, Tonga, Trinidad and Tobago, Tunisia, Turkey, Turkmenistan, Tuvalu, Ukraine, United Arab Emirates, United Kingdom (and Overseas Territories), United States (and Overseas Territories), Uzbekistan, South Africa, Sri Lanka, Sweden, Switzerland, Vanuatu, Western Sahara, Yemen.
24. Clients must pay for services, postage, and Package Protection Program fees from their own account(s).The name on invoices (for example, on invoices from the seller) must match the name of the owner of the bank account (and the Dester account). In the event of a discrepancy or suspicious activity, the Service reserves the right to withhold funds from an account. Also, the Service may request documents to confirm the identity (confidentiality of information is guaranteed). Clients undertake (if necessary) to provide copies of two identification documents and notary form 1583 for each person making payment, or other documents requested.
25. Duplicate accounts are not allowed (for example, multiple accounts all paid from the same bank account). An existing user cannot add their name to someone else's Clients account.
26. The Client is responsible for all customs duties in your own country, or in the country to which you are shipping your packages, and for all shipping charges – even if assessed later by the carrier. Said duties or charges are in addition to the fees earned by the Service for its package/mail forwarding services, and to the Package Protection Program fees. The Client assumes the obligation to fully pay (directly or through the Service or a person authorized by the Service) government taxes and import VAT applicable to the total cost of the Goods, including insurance, freight, contingencies associated with transportation, and customs duties ("Import VAT" ), as well as any other fees of third parties, including customs duties, which are payable when sending the goods of the Client's parcels.The Client understands and agrees that all such taxes, VAT, Import VAT and third party charges will be paid by the Client prior to the delivery of his parcel.
The Client undertakes to pay in full all applicable Shipping Fees and other charges, including customs duties and import VAT, for any Shipment ordered to his Account, upon request of the Service and regardless of the person who placed the order. Assuming that the Client provided accurate information for the customs declaration and customs does not dispute the value, the amount of import VAT and customs duties actually charged by the customs authorities may differ from the amount that the Client paid the Service. In the event that the actual customs duty and import VAT exceed the estimated amount charged by the Service, the Service has the right to charge the Client a fee. And in this case, the Client pays the difference along with any fines, expenses incurred by the Service due to the provided inaccurate information.
The client assumes the obligation to fully pay VAT (standard):
Saudi Arabia - 15%
The UAE - 5%
Oman - 5%
Bahrain - 10%
Kuwait - 5%
Qatar - 5%
And VAT (increased):
The UAE - carbonated, and sweetened beverages products have a 50% duty, and energy drinks, e-smoking devices (tools and liquids used in them) and tobacco products are assessed a 100% customs duty.
Saudi Arabia - taxes on cigarettes at a rate of 100%, carbonated drinks at a rate of 50%, and energy drinks at a rate of 100%.
Bahrain - for alcoholic beverages at a rate 225%, and cigarettes at a rate 200%.Certain categories of goods, such as paper and aluminum products, are subject to a 20% duty rate.
27. Clients can contact the Service to investigate the reasons for the delay in delivery or write an email. The Service accepts applications for consideration within the time limits established by DHL rules. After 90 days from the date of sending the parcel, applications will not be accepted.
28. The Service does not carry out the investigation but acts as an agent to start the inquiry with the carrier. All terms and conditions of the selected shipping service apply to the inquiry.
29. The Service offers a private Package Protection Program for packages dispatched from our warehouse to be shipped internationally or domestically. The Package Protection Program covers:
Loss of the package;
Damage to package contents;
Missing contents upon delivery.
The fee for the Package Protection Program is included in the cost of the rates paid by the Client to the Service. The amount of compensation is limited to the nominal value of the goods, fixed in the invoice of the store/seller. Any other types of losses or damages (including, but not limited to, lost profits, interest income), regardless of whether such damages and losses are direct or indirect, are not subject to compensation to the Client, even if the Service was notified of the risk of such damage or loss.
30. The Package Protection Program fees for a package are based on the value of its contents.
31. Clients agree that overstating the value of a package’s contents for Package Protection Program purposes will be viewed as fraudulent activity and result in an automatic rejection of the Package Protection Program claim.
32. All claims are reviewed individually. Any payment will be based on the insured value. Claims are subject to the terms and conditions of the particular carrier’s airway bill(s).
33. Any problem with the package received by the Client must be reported within 7 days of delivery, and no later than 90 days from the shipping date. Clients agree that any Package Protection Program claim filed later that 7 days after delivery, and later than 90 days after the shipping date, will be automatically denied.
34. Clients will be asked to provide information regarding the claim including, but not limited to:
A copy of the postal report;
A copy of the invoice (document of payment) with the terms of sale;
Photo(s) or other descriptions of the goods, besides the commercial invoice (e.g., photo retrieved from website);
Photos of the packaging, containers, etc.;
Detailed product photos if it is damaged;
Repair estimate if the merchandise is damaged, yet repairable.
35. Payments will not be made when:
The delivery has been delayed;
The contents of the package are illegal or prohibited from shipping;
Any item(s) are seized by customs authorities or any other government agency.
36. The Client agrees to reimburse all fees, fines, penalties, claims, chargebacks, and other debts to the Service, or a third-party caused by the Client’s breach of this Terms of Service, and/or (mis)use of the services.
37. This Terms of Service is mandatory for all Clients, regardless of the country of residence. The Service has the right to refuse to provide services to the Client, if the Client violates obligations/rules established by this Terms of Service.
38. The Service guarantees the confidentiality of personal information provided by the user (including passport data, card number, eBay account login information, etc.).
39. The Client is obliged to indicate the full address of the residence (addresses of the post office, mailbox are prohibited). If you specify the post office address as the delivery address, the Service reserves to request documents to confirm the Client’s identity.
40. The Client undertakes to pay for the goods purchased with delivery to the address of the Service warehouse, only with his payment cards/invoices. It is not allowed to pay for goods by gift cards, Bitcoin currency and accounts of third parties. It is also prohibited to pay for goods with non-registered cards and premium miles of airlines, passenger companies, etc. 41. Please take into account the inaccuracy when converting the weights, as well as factors of different room humidity, etc., when comparing the weight of the package when sending and receiving. A slight difference in weight is permissible (20 grams for the "small package" type of item, 50 grams for the "package" type of item). If there is a significant difference in weight, the Client has the right to contact the Service to consider a claim on this issue. 42. The Client undertakes to provide real data regarding the quantity and value of goods in packages, as well as invoices to confirm the value of goods. The Service has the right to indicate in the declaration the correct information in accordance with the provided invoices, regardless of the prices/quantities of goods indicated by the Client manually.
43. By registering on the Service and using the address of the Service for the purchase and shipment of goods, the Client confirms that he:
is the end user of the goods;
purchases goods not for resale;
is not a member and is not a member of any military or terrorist organization/group;
the product is purchased for personal use exclusively for peaceful purposes.
44. The Client can withdraw funds by completing the application in the appropriate section. Withdrawals can only be made to the card from which the account was previously top-upped. The amount to be deducted is less than or equal to the amount of the replenishment. Withdrawals of funds credited under the Package Protection Program exceeding the amount of deposits from the card can be made to an account in the PayPal payment system. Within 15 (fifteen) working days, the funds are returned to the Client or the Service refuses to withdraw funds in case of insufficient data provided by the Client in the application or if there is a debt of the Client.
